Winston & Strawn Partner and Chair of the Environmental Litigation & Enforcement group, Jonathan Brightbill, evaluated how the recent Supreme Court ruling on abortions will impact future rulings on environmental law and policy in E&E News.

“The majority opinion’s passing reference to third-party standing doesn’t imply there should be a tightening of standing for environmental cases,” Jonathan said.

The Dobbs decision, however, “further calls into question the decision of the Oregon district court in Juliana v. United States to recognize a constitutional ‘right to a climate system capable of sustaining human life,’” as the “Juliana opinion expressly relied on Roe.”
