Jonathan Brightbill Discusses Challenges to Regulations in Biden Administration’s Climate Pledge with Politico

Winston & Strawn partner Jonathan Brightbill was interviewed for a Politico article discussing the three cases that will challenge regulations critical to the Biden administration’s plan to significantly boost electric vehicle sales. Two cases that will be heard by the D.C. Circuit challenge rules from EPA and the Transportation Department that strengthened tailpipe emissions and tightened fuel economy standards through model year 2026. The third case challenges the Clean Air Act provision that allows California to adopt more stringent auto pollution rules than the federal government. 

The challengers “are presenting legal issues that, once adjudicated, could have significant implications for the later rules that have been proposed and are in the pipeline and seek to impose even more stringent standards,” Jonathan said. The cases present questions where there could be “a good bit of interest to certain of the justices of the Supreme Court,” he said.
