Winston & Strawn Partner Jason Lewis was featured in a Law360 article discussing the Texas energy market one year after Winter Storm Uri. 

Uri knocked nearly half of Texas’ electricity supply offline for several days in February 2021, leaving millions of people in the dark while power suppliers scrambled to buy electricity from the state’s spot market at inflated prices. A healthy chunk of the power contract litigation stemming from the storm has centered around whether generation outages constitute a force majeure, or act of God, event.

“Everyone wants to have a clearer sense of when a seller can declare force majeure under a contract, be that a power purchase agreement, or a hedge, or a gas sale,” Jason said. “In cases, I’ve seen both buyers and sellers trying to be clearer about what is and what is not force majeure.”
