How the America Invents Act’s Post-Issuance Proceedings Influence Litigation Strategy

Winston & Strawn hosted an eLunch titled "How the America Invents Act's Post-Issuance Proceedings Influence Litigation Strategy" on Thursday, August 23, 2012 at 12:15 (Central).
On September 16, 2012, provisions of the Leahy-Smith America Invents Act ("AIA") take effect that broaden the USPTO's authority to take another look at the validity of issued patents. The AIA's provisions include post-grant review, inter partes review, and the transitional program for covered business method patents and require the newly-renamed Patent Trial and Appeal Board to conduct trials on certain patentability issues. Needless to say, litigators need to understand how these new provisions might impact litigation strategies.
Winston & Strawn attorney Andrew Sommer led a practical, interactive discussion that examined these new ways to challenge the validity of issued patents. The program reviewed:
- the new post-grant review, inter partes review, and the transitional program for covered business method patents provisions of the AIA;
- the USPTO's proposed rules packages for implementing these proceedings; and
- the potential impact these new proceedings will have on patent litigation and new avenues that these proceedings open up for companies in defending themselves in patent litigation.
