Daniel Stabile Discusses Recent SEC Digital Asset Lawsuits

Winston & Strawn Partner and Digital Assets and Blockchain Technology Group Co-Chair Daniel Stabile discussed the potential for congressional action following the lawsuits recently filed by the U.S. Securities and Exchange Commission against digital asset exchanges in Law360, Forbes, and Yahoo! Finance. The complaints include allegations that the digital asset exchanges should have been registered with the SEC because certain digital assets trading on the platforms are securities under U.S. law.
Daniel told Law360 that he believes Congress will need to intervene to sort out the “regulatory morass” of agencies vying for jurisdiction.
The intensifying SEC activity could encourage Congress to write clearer rules for digital assets. “The SEC’s rhetoric has clearly escalated in this most recent round of cases,” says Daniel said in an interview with Forbes. “The key is whether we are going to get adjudication in one of these cases soon and the sequencing of that with regards to congressional action that would have a radical impact on the SEC’s authority to regulate this space.”
