The UAE and the wider Middle East is quickly emerging as one of the most attractive destinations for global investors and multinational organizations, lauded for its ease of doing business and strategic geographical location.
In a region where the emphasis in business is very much on relationships, trust, and confidentiality, arbitration continues to play a central role as the resolution method of choice for the many multinational corporations headquartered in the region.
On May 3, 2018, new UAE Arbitration Law, Federal Law No. 6 of 2018, was issued by the UAE Government (the New Law) and widely welcomed within the business and legal community in the emirate and across the wider Middle East.
According to Ben Bruton, Dispute Resolution and Investigations Partner at Winston & Strawn, in a recent article for fivehundred magazine, the enacting of the New Law has given the UAE a modern framework for arbitration, which will ultimately lead to stronger investor confidence in the UAE and wider Middle East.
Ben commented: “The New Law will ensure that arbitration in the UAE continues along on its positive and progressive course and that the UAE remains on a par with the other major arbitral seats around the world. For as long as the UAE maintains this encouraging trajectory, it should stimulate continued investment from key global markets, cementing its place as one of the strongest and most internationally diverse economies in the region.”
Earlier this year, Winston & Strawn participated in the inaugural Legal 500 Middle East Disputes Summit in Dubai, which brought together some of the most high-profile and experienced general counsel operating in the Middle East. During the event, views were exchanged on some of the key topics surrounding dispute resolution and compliance in the UAE and wider Middle East region.
