Barry Shelton Discusses the Current State of Waco Patent Litigation in Law360

Winston & Strawn Partner Barry Shelton, who focuses his practice on intellectual property, sat down with Law360 to discuss the Western District of Texas’ patent litigation stronghold and the judges that preside there.
Judge Albright was a topic of controversy when he first started soliciting cases in Waco, as the intellectual property community worried that his court would be a “haven for patent owners.”
However, Barry notes that that’s not the case. “I don’t think you could look at these statistics and say, ‘This is a court where plaintiffs win everything and leave Waco with huge verdicts.’ It just hasn’t happened.”
Barry also discussed the swearing-in of a second magistrate judge, Judge Derek Gilliland. “He’s already been a huge help to Judge Albright’s dockets because he’s taking things that Judge Albright would,” he said.
