Winston & Strawn presented an eLunch titled "Analysis of the Impact on the Electric Utility Industry of EPA’s Proposed Greenhouse Gas Limits on New Power Plants," on April 26, 2012 at 12:15 p.m. (Central)

On March 27, 2012, EPA proposed the first greenhouse gas limits on new stationary sources under the New Source Performance Standard (“NSPS”) provision of the Clean Air Act. These proposed rules resulted from a settlement agreement between EPA and a number of environmental organizations, and will have a profound impact on the future of the country’s electric generation if finalized. The rule has prompted substantial debate over the extent to which it will have an impact on climate change, the economy, and the country’s energy policy.

Garry Rice, Deputy General Counsel at Duke Energy Corporation, and Winston & Strawn LLP attorney Averil Edwards led a practical, interactive webinar that provided an overview of the rule and its potential effects on the electric utility industry. The discussion reviewed:

  • the basic provisions of the proposed rule;
  • its impact on new and existing electric utilities; 
  • potential legal challenges to the rule; and
  • other topics raised by this important rulemaking.
