The American Health Law Association’s Annual Meeting took place on June 24-26, 2024, in Washington, D.C., and Winston’s Health Care & Life Sciences Industry Group attorneys participated in various ways.

Featured Panelist

Partner Amy Kearbey participated in a panel made up of former HHS-OIG attorneys (Samantha Flanzer, Lead Counsel of Walmart Health & Wellness, and Stewart Kameen of Bass, Berry & Sims). The panelists shared their advice with industry stakeholders on “Patient Engagement: Strategic Considerations for Providing Tools and Support to Patients to Promote Care Coordination and Advance Value-Based Care.” Three key takeaways from the panel are:

  • Providing tools and support to patients can help address social determinants of health and otherwise engage patients in their care to promote better health outcomes
  • These types of arrangements often implicate both the federal Anti-Kickback Statute and the Beneficiary Inducements CMP
  • OIG has created several pathways that can insulate stakeholders from liability when providing these types of tools and supports, but each arrangement needs to be thoughtfully structured and carefully implemented
