U.S. Maritime Administration Issues Jones Act Waiver Guidance

On November 4, 2012, the U.S. Maritime Administration (MARAD) posted on its website guidance regarding the Jones Act waiver issued on November 2 and modified on November 3 by the Secretary of the U.S. Department of Homeland Security. The MARAD guidance indicates that the waiver applies to "refined petroleum, not crude which includes gasoline, diesel fuel, heating oil, jet fuel and the necessary volume of other feedstocks, blending components, and additives used to produce fuels." The MARAD notice also provides a point of contact for the delivery of required waiver notices and anticipates potential waiver modifications if port congestion or other problems in New York prevent deliveries by the waiver deadline of November 20.
