Oil Pollution Act: Legislative Changes, Amendments Set Agenda for New Congress

Amendments to the Oil Pollution Act of 1990 proved very limited in the immediate wake of the Deepwater Horizon incident, but the proposed amendments that passed the House of Representatives and proposals by key energy industry supporters in the Senate during the 111th Congress highlight the agenda of reform that is likely to be pursued in the new Congress. Considering the dramatic results of the congressional midterm election, it appears unlikely that the sweeping changes to the Oil Pollution Act of 1990 proposed in the 111th Congress will be adopted. However, significant legislative change could be advanced by supporters of the energy and maritime industries, if they decide changes will strengthen the industries by securing a more predictable legal regime.
