Jones Act Waiver Issued for Hurricane Sandy

On November 2, 2012, the Department of Homeland Security issued a waiver of the Jones Act for the transportation of "petroleum products" from the U.S. Gulf of Mexico to the U.S. Northeast for shipments loaded on or before November 13 and delivered on or before November 20 (Waiver of Compliance with Navigation Laws attached). The waiver was modified on November 3 to include "feedstocks, blending components, and additives used to produce fuel." Waivers are conditioned upon the provision of a notice to the U.S. Maritime Administration within 24 hours of loading and within 72 hours of discharge. Similar waivers were granted following Hurricanes Rita and Katrina.
