On December 22, 2009, the U.S. Environmental Protection Agency (“EPA”) brought an early
Christmas present to environmental groups when it announced it had finalized its rulemaking applying more stringent standards to large marine diesel “Category 3” engines above 30 liters per cylinder. The EPA rule is part of a comprehensive, 3-pronged
strategy that the EPA has been cinching tighter for the last several years, which includes, in addition to the Clean Air Act, the implementation of tougher standards under MARPOL Annex VI and the designation of a MARPOL Emissions Control Area (“ECA”), imposing the highest MARPOL air emission standards available for United States and Canada coastal areas. |
