The author discusses a recent decision by the U.S. Supreme Court holding that the National Labor Relations Act preempts a California law that prohibits certain employers that receive state funds from using those funds “to assist, promote, or deter union organizing.” The Court found it “beyond dispute” that the provisions of the statute sought to regulate “a zone protected and reserved for market freedom.” |
