Winston & Strawn energy partner Joe Karp, who focuses
his practice on energy regulatory, transactional, and project development
matters, was quoted in an article titled "Governor Sets High Renewable
Energy Goals," that was published in the September 18, 2009 issue of the San
Francisco Daily Law Journal.
The article discusses how California Gov. Arnold
Schwarzenegger set a higher target for boosting renewable energy use in
California to 33 percent by 2020. In issuing an executive order, his decision
to bypass the legislature could create additional legal problems.
Schwarzenegger’s move comes after the legislature passed the
AB64 and SB14 bills that set the same target, however, the governor criticized
the bills for being inflexible and limiting how much out-of-state power
utilities could use to meet the 33 percent target goal. Schwarzenegger said he
would veto both bills
"There's a question in some people's minds if he
[Shwarzenegger] can mandate a 33 percent renewable portfolio standard,"
said Karp, who represents the California Wind Energy Association, which
supported the bills. "Having it in the statute would eliminate any doubt
on the subject."
