Peter McCabe is a litigation partner in Winston & Strawn’s Chicago office. Mr. McCabe has provided trial and appellate representation of individuals and corporations in major civil and criminal litigation in the federal and state courts. He has successfully tried a number of major patent cases, including Verizon Communications v. Vonage Holdings, 503 F.3d 1295 (Fed. Cir. 2007), Nobelpharma AB v. Implant Innovations, Inc. 141 F.3d 1059 (Fed Cir. 1998), and Syndia Corporation v. The Gillette Company. His representative clients include Verizon Communications Inc., Verizon Wireless, Motorola, Inc., Abbott Laboratories, C.R. Bard, Inc., Thomson Multimedia, Inc. (RCA), Microsoft Corporation, Ford Motor Company, and Hyundai Motors America.

Honors and Awards

The National Law Journal ranked Verizon Services Inc. v. Vonage Holdings Corp., in which Mr. McCabe represented the plaintiff, as No. 25 among the top 100 verdicts of 2007 in its Feb. 18, 2008 issue. In 2009, Mr. McCabe was named as an Illinois Super Lawyer.

Activities

Mr. McCabe is a member of the Federal Circuit Bar Association, Rules Committee, and the Seventh Circuit Bar Association, and is an alumni member of the Indiana University Law School Board of Overseers.

Education

Mr. McCabe received a B.A., cum laude, from Harvard University in 1982 and a J.D., magna cum laude, from Indiana University School of Law in 1985, where he was the articles editor of the Indiana Law Journal.

Mr. McCabe is the author of the following articles on patent litigation topics: “Conflicts in Federal Circuit Patent Law Decisions: The Written Description Requirement of Section 112, First Paragraph,” The Federal Circuit Bar Journal, Vol. 1, No. 3 at 725 (2002); “Strategies for Defending Antitrust Claims Arising from Fraudulent Patent Procurement in Sham Litigation,” Private Antitrust Litigation News, Winter 1998, at 13. Mr. McCabe also is co-author (with Edward L. Foote) of “Cross-Examination,” Chapter 36 of Business and Commercial Litigation in Federal Courts (Second Edition), editor Robert L. Haig (Thomson/West 2005).
