Krista Enns is a litigation partner in Winston & Strawn's San Francisco office who concentrates her practice in complex commercial matters, including class actions. She has defended companies and individuals against allegations of securities fraud, insider trading, and deceptive trade practices. She also has experience with state tax, fiduciary duty, and intellectual property matters.

Select examples of matters handled by Ms. Enns include:

  • Defense of a company and its officers in private plaintiff securities fraud and insider trading class action.
  • Defense of an individual related to allegations of insider trading by the SEC.
  • Defense of a company alleged to have wrongfully paid its hourly employees.
  • Representation of a bankruptcy trustee in a federal bankruptcy court matter involving breach of fiduciary duty and fraudulent transfer claims against multiple former officers and directors of a failed subprime mortgage lender.
  • Preservation a $15.9 million verdict before the Ninth Circuit in a case involving complex real estate and contractual interpretation issues. First Nat’l Mortg. Co. v. Federal Realty Inv. Trust, 631 F.3d 1058 (9th Cir. 2011).
  • Litigation against California state governmental agencies as to the amount of taxes owed.
  • Representation of clients in civil antitrust matters ranging from exclusionary conduct to price fixing.
  • Representation of clients in deceptive trade practices cases, including cases alleging antitrust violations, unfair competition, fraud, violations of the CLRA, and breach of warranty.

Ms. Enns was part of the Winston Cisco team that won Cisco's inaugural Commercial Litigation Law Firm of the Year Award. Cisco created this award as a way to recognize the law firm that most exemplifies excellence in partnering with Cisco.


Activities

Ms. Enns serves on the Board of Directors of OneJustice, an organization focused on expanding legal help for Californian’s in need, and on the Board of Directors of the Duke Law Alumni Association.  She also is a member of the American Bar Association.


Education

Ms. Enns received a B.A. in History from Pomona College, an M.P.P. from the Sanford Institute of Public Policy at Duke University, and a J.D. from Duke University School of Law, where she was the Managing Editor for the Duke Law Journal.

Other Experience

Ms. Enns previously served as a law clerk to the Hon. Mary Beck Briscoe of the U.S. Court of Appeals for the Tenth Circuit and to the Hon. Oliver Wanger of the U.S. District Court for the Eastern District of California. She also served as a legislative aide to Rep. Gwenn Klingler of the Illinois House of Representatives (100th District).
