| Summary: In September 1996, in response to citizen complaints of pollution, the USCG investigated and later indicted Varlack Ventures and Inter Island Boat Services of failing to notify the USCG of the discharge of oil, in violation of OPA. |

| Result: In October 1998 Hubert Fredericks was found guilty by jury of violating the notification requirement of OPA, and in December Varlack Ventures pled guilty to an OPA discharge violation. Fredericks was sentenced to eight months imprisonment, three years supervised release, a $1,000 fine, and 150 hours of community service, while Varlack Ventures was sentenced to a $50,000 fine and five years probation. In January 1999, Clifton Boynes and Inter Island Ferry Services were acquitted by jury of one CWA violation. |
