On behalf of PSI Energy, Inc. and Cincinnati Gas & Electric Co., our attorneys obtained a reversal of a Court of Federal Claims decision denying our client's claims for recovering millions of dollars in “special assessments” imposed by the Energy Policy Act of 1992. The Federal Circuit remanded the case with an order to award CGE and PSI full recovery of all assessments paid plus interest and effectively freed the utilities from further payments.

The financing was a part of a reorganization and sale transaction in which Northland Holdings, Inc.'s fuel business was distributed to Northland Fuel LLC and its freight business was sold to Endeavour Capital.
Large Utility CFTC Investigation

We represented a large utility in an investigation conducted by the Commodity Futures Trading Commission into whether the utility had provided misleading price information on natural gas trades to an industry trade publication. We helped the client navigate a series of CFTC subpoenas and depositions, and ultimately persuaded the CFTC to terminate the investigation without any finding of wrongdoing or assessment of penalties.
$304 Million RS Cogen Project Financing

Winston & Strawn represented RS Cogen, LLC (a joint venture between PPG Industries Inc. and Entergy Power Group) in connection with the $304 million project development and financing of a 425 MW gas-fired combined cycle cogeneration facility in Lake Charles, Louisiana.
$58 Million Sale by Auction of CH Resources to WPS Power

Winston & Strawn represented CH Energy Group, Inc. in the $58 million sale of CH Resources, Inc., its indirect wholly owned subsidiary, to WPS Power Development Inc., a subsidiary of Wisconsin Public Service Corporation. The deal was the result of an auction process conducted by Navigant Consulting, Inc.
CIT $360 Million Financing of CCGT Alphagen Power Generation Facility

Winston & Strawn represented CIT Group in a $360 million construction and leveraged lease take-out financing for the development, construction, and operation of a 535 MW CCGT Alphagen gas-fired power generation facility in Michigan, which was named by Project Finance Magazine as it's "Americas Project Lease Deal of the Year" for 2002.
