| Winston & Strawn recently represented GE and GE Industrial Systems in connection with a destruction of business claim by a defunct treadmill manufacturer. The plaintiff, Roadmaster, sued GE claiming $116 million in damages on the theory that a recall of the treadmills ruined its reputation in the marketplace and drove its treadmill business into bankruptcy. After several years of hard-fought litigation, including a partial summary judgment victory that devastated Roadmaster?s case, a Winston & Strawn team settled the case for a small fraction of the plaintiff?s claim. |
