Winston & Strawn represented Smurfit Newsprint in an appeal before the Seventh Circuit, which ruled in favor of our client. In a reported decision, the Court held that New York insurance law did not apply to the issue of notice for a general commercial indemnity contract. The case was discussed in the well-known treatise Corbin on Contracts as a noteworthy case dealing with the issue of conditions precedent.
