| A Winston & Strawn litigation team of New York office attorneys secured a favorable settlement on behalf of Cunningham Lindsey Claims Management, Inc. in an action brought by Fireman''s Fund Insurance Company in the Eastern District of New York involving claims of negligence, negligent misrepresentation, breach of fiduciary duty, and breach of contract. After extensive fact and expert discovery, which included over 30 depositions, the Magistrate Judge issued a report and recommendation granting our client''s motion for summary judgment on Fireman''s Fund''s claims for negligence, negligent misrepresentation, and breach of fiduciary duty. Facing a trial limited to its breach of contract claim, Fireman''s Fund agreed to settle the matter for a small fraction of the more than $50 million it originally sought. |
