Old Orchard Urban Limited Partnership v. Harry Rosen, Inc.

Winston & Strawn represented Harry Rosen, Inc., a Canadian corporation, in a contract lawsuit filed in Cook County, Illinois, by Old Orchard Urban Limited Partnership (Urban) seeking to enforce and collect on a default judgment entered against Specialty Stores, an indirect subsidiary of Harry Rosen. Urban obtained a $2.7 million default judgment in federal court against Specialty Stores relating to a lease of a store in the Old Orchard Shopping Center in Skokie, Illinois. After Specialty Stores failed to satisfy the judgment due to insolvency, Urban filed a lawsuit against Harry Rosen seeking to pierce the corporate veil and collect the default judgment plus post-judgment interest and attorneys fees for a total of more than $4 million. The Winston team presented evidence and legal authority to defeat a prima facie case of personal jurisdiction over Harry Rosen based on an alter ego or pierce the corporate veil theory, and the court dismissed the case against our client.
