Environmental Litigation Update
June 13, 2013
Winston & Strawn hosted an eLunch titled "Environmental Litigation Update" on Thursday, June 13, 2013 at 12:15 – 1:30 p.m. (Central).
President Obama's first term has seen the executive branch engage in an active regulatory agenda in the environmental area. As is usually the case with environmental regulations, many of these rules have landed before the courts. Recently, the Supreme Court of the United States issued two significant decisions under the Clean Water Act.
Winston & Strawn environmental attorney Eleni Kouimelis presented a practical program that discussed the most significant environmental cases that have been recently decided by the Supreme Court and other federal appellate courts, as well as highlighted certain noteworthy cases presently pending before the courts.
This discussion focused on:
- Two Supreme Court recent cases on the Clean Water Act: Los Angeles County Flood Control District v. Natural Resources Defense Council and Decker v. Northwest Environmental Defense Center
- Ongoing legal challenges to EPA's Cross-State Air Pollution Rule
- Legal challenges and recent decisions regarding climate change and EPA's greenhouse gas regulations
- Pending lawsuit challenging SEC's "Conflict Minerals Rule"
